Diritto di Recesso

Ai sensi del D.Lgs. 206/2005 (Codice del Consumo) e della Direttiva UE 2011/83/UE, il consumatore ha il diritto di recedere dal contratto di acquisto senza dover fornire alcuna motivazione.

Termine per esercitare il diritto di recesso

Il consumatore dispone di 14 giorni per esercitare il diritto di recesso a decorrere dal giorno in cui il consumatore o un terzo da lui designato, diverso dal vettore, acquisisce il possesso fisico dei beni.

Come esercitare il diritto di recesso

Per esercitare il diritto di recesso, il consumatore è tenuto a informare Archivio Ferrari della propria decisione di recedere dal presente contratto tramite una dichiarazione esplicita (ad esempio una lettera inviata per posta o per posta elettronica) ai seguenti recapiti:

Il consumatore può utilizzare il modulo di recesso tipo allegato in fondo a questa pagina, ma non è obbligatorio.

Per rispettare il termine di recesso è sufficiente che il consumatore invii la comunicazione relativa all'esercizio del diritto di recesso prima della scadenza del periodo di recesso.

Effetti del recesso

In caso di recesso dal presente contratto, saranno rimborsati tutti i pagamenti ricevuti dal consumatore, compresi i costi di consegna (ad eccezione dei costi supplementari derivanti dalla scelta di un tipo di consegna diverso dal tipo meno costoso di consegna standard offerto), senza indebito ritardo e in ogni caso non oltre 14 giorni dal giorno in cui siamo informati della decisione del consumatore di recedere dal presente contratto.

Detti rimborsi saranno effettuati utilizzando lo stesso mezzo di pagamento usato dal consumatore per la transazione iniziale, salvo che il consumatore abbia espressamente convenuto altrimenti; in ogni caso, il consumatore non sosterrà alcun costo quale conseguenza di tale rimborso.

Il rimborso potrà essere sospeso fino al ricevimento dei beni oppure fino a quando il consumatore non abbia dimostrato di aver rispedito i beni, a seconda di quale situazione si verifichi per prima.

Restituzione dei beni

Il consumatore è tenuto a rispedire i beni o a consegnarli a Archivio Ferrari senza indebito ritardo e in ogni caso entro 14 giorni dalla data in cui ha comunicato il recesso dal presente contratto. Il termine è rispettato se il consumatore rispedisce i beni prima della scadenza del periodo di 14 giorni.

I costi diretti della restituzione dei beni sono a carico del consumatore.

Il consumatore è responsabile della diminuzione del valore dei beni risultante da una manipolazione dei beni diversa da quella necessaria per stabilire la natura, le caratteristiche e il funzionamento dei beni.

Esclusioni dal diritto di recesso

Il diritto di recesso è escluso per:

  • Beni confezionati su misura o chiaramente personalizzati;
  • Beni che rischiano di deteriorarsi o scadere rapidamente;
  • Beni sigillati che non si prestano ad essere restituiti per motivi igienici o connessi alla protezione della salute e sono stati aperti dopo la consegna;
  • Beni che, dopo la consegna, risultano, per loro natura, inscindibilmente mescolati con altri beni.

Right of Withdrawal

Pursuant to EU Directive 2011/83/EU on consumer rights, you have the right to withdraw from your purchase contract without giving any reason.

Withdrawal Period

You have 14 days to exercise your right of withdrawal from the day on which you, or a third party other than the carrier and indicated by you, acquires physical possession of the goods.

How to Exercise the Right of Withdrawal

To exercise the right of withdrawal, you must inform Archivio Ferrari of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or email) to the following contact details:

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract.

We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Return of Goods

You shall send back the goods or hand them over to Archivio Ferrari without undue delay and in any event not later than 14 days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.

You will have to bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusions from the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to the consumer's specifications or clearly personalised;
  • Goods which are liable to deteriorate or expire rapidly;
  • Sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
  • Goods which are, after delivery, according to their nature, inseparably mixed with other items.
